Terms of Service

Operator and agreement

By using JobTorq, you agree to these terms to the extent permitted by law. If you use it for an organisation, you must be authorised to do so. A separately agreed written service agreement takes priority where it expressly differs from these terms.

Accounts and permitted use

Use only an account or workspace you are authorised to access. Keep your access credentials and invitation codes secure, give accurate account information and promptly report suspected misuse. Your organisation manages its users, roles and the records those users can access.

Do not use JobTorq unlawfully; access another tenant’s information without authority; introduce malicious files; interfere with the service; or upload content you have no right to use. Do not share an account to create a misleading record of another person’s actions or acknowledgement.

Workplace safety remains your responsibility

JobTorq helps organise and document work. It does not replace competent supervision, site inspections, equipment instructions, permits, training, professional advice or duties imposed by workplace safety law.

Your organisation and workers must check conditions, select suitable controls and PPE, verify qualifications and equipment suitability, and stop work when unsafe. A completed prestart, sign-on, reminder or risk assessment is a record of information entered, not a certification that work is safe or legally compliant. Do not rely on JobTorq as an emergency notification service.

AI-generated material

AI features suggest briefings, risks, controls, questions and extracted document fields. They can omit information, misunderstand context or produce incorrect results. A competent person must review and correct output before publishing it, saving a credential or relying on it for work.

Provide enough accurate context and do not submit information you are not authorised to share with the AI provider. You can use manual entry instead. AI assistance does not verify the authenticity of a licence, certificate or other document.

Your records and content

You and your organisation retain your existing rights in content submitted to JobTorq. You grant us the permission needed to host, process, display, transmit and back up that content to provide the service, including processing through selected features and service providers.

Your organisation is responsible for the accuracy, lawfulness and appropriate retention of its records, and for required notices or consents concerning employees, customers and others. Keep independent copies where required for your business or legal obligations. Our Privacy Policy explains information handling and requests for access or correction.

Availability, integrations and development access

We may maintain, update or change the service. Unless separately agreed, we do not promise uninterrupted access or a particular response time. Internet connectivity and third-party storage, identity, email and AI services can affect features.

Features marked as development, demo, preview or simulated are for evaluation. Customer workspace identities in the current demo are simulated, even when an owner signs in with Microsoft. The demo is not a production safety record or secure live employee system. Do not enter real sensitive personnel information into it. A planned feature or marketing illustration is not a promise of a delivery date.

Fees and subscriptions

Any paid plan, price, billing period and cancellation terms must be separately disclosed and agreed before charges apply. These terms do not create a subscription or authorise payment by themselves.

Suspension and ending access

We may restrict access where reasonably necessary to address a security threat, unlawful activity, material misuse or a legal requirement. Where practicable, we will explain the reason and provide an opportunity to resolve the issue. An organisation may also remove its own users’ access.

Contact us to discuss closing an organisation’s workspace and obtaining its records. Ending access does not automatically delete records that must be retained for lawful purposes. Retention and deletion are handled as described in the Privacy Policy and any applicable service agreement.

Intellectual property

The JobTorq platform, branding and original site content are owned by their respective rights holders. You may use them as necessary to use the service. These terms do not transfer ownership of the platform or allow you to resell it, copy its branding or present yourself as its operator without permission.

Consumer rights and responsibility

Nothing in these terms excludes, restricts or modifies a guarantee, right or remedy that cannot lawfully be excluded, including applicable rights under the Australian Consumer Law. Any limitation in a separate service agreement remains subject to those rights.

We do not guarantee that information entered by users or generated by AI is accurate, complete or fit for a particular job. Each party remains responsible for its own conduct and obligations under applicable law. These terms do not release us from liability that cannot lawfully be excluded.

Changes and questions

We may update these terms as the service changes. We will show the revision date and provide appropriate notice of material changes; changes do not retrospectively remove accrued rights. If you disagree with a material change, contact us to discuss ending use and managing your organisation’s records.
